The judiciary is seeking various approaches to school violence and is making an in-depth effort to prevent school violence and to guide and educate the perpetrators. The problem of school violence is manifesting as a chronic and inevitable form of modern society, gradually increasing the level of criticism against the perpetrators from the point of view of education, and social consensus that demands strong punishment for juvenile offenders is becoming visible. In this situation, the police are in a dilemma of whether they should cooperate through public power by assigning criminal legal concepts to cope with school violence, or to provide police services and leave the subject of punishment inside the educational institution. Until now, the police have gradually expanded the scope of police rights to educational institutions, and have recognized the importance of supporting and protecting victims. It is not the intrinsic role that the police should pursue in the future, as it is the direction that demands strong punishment against the perpetrator in accordance with the characteristics of school violence crime. The purpose of this study is to diagnose the current situation and problems of police coping with school violence prevention, and to suggest the direction of police role on juvenile problem.

사법기관은 학교폭력에 대한 다양한 접근방식을 모색하여 학교폭력예방과 가해자 선도 및 교육에 심도있는 노력을 기울이고 있다. 학교폭력의 문제가 현대사회의 고질적이고 필연적인 형태로 발현되고 있고 점차 교육의 관점에서 벗어나 가해자에 대한 비난의 수위가 높아지고 소년범에 대한 강력한 처벌을 요구하는 사회적 합의가 가시화되고 있다. 이러한 상황에서 경찰은 학교폭력에 대응하기 위해 형사법적 개념을 대 입하여 공권력을 통해 협력해야 하는 것인가 아니면 경찰서비스를 제공하고 처벌의 주체를 교육기관 내부로 남겨두어야 하는가의 딜레마에 빠져 있다. 현재까지 경찰은 점차 경찰권의 영역을 교육기관으로 확장하는 동시에 피해자 지원 및 보호에 대한 중요성을 인식하고 있다. 이는 학교폭력범죄의 특성에 맞추어 가해자에 대한 강력한 처벌을 요구하는 방향성에 편승한 것으로 앞으로 경찰이 추구해야 할 본질적인 역할로 볼 수는 없다. 이에 본 연구는 경찰의 학교폭력예방에 대한 대책현황과 문제점을 진단 하고 피해청소년 문제에 대한 경찰역할의 방향성을 제시하는 것을 그 목적으로 한다.
