Elderly criminals have been looked over due to their numerical inferiority and traits for long time at the center of korean judicial policy. But rapid graying and complex changes in korea society has brought about many elderly criminals. Therefore existing path-dependence judicial policy has showed diverse limits to cope with increasing elderly criminals in korea and new judicial policy which can contribute to decline recidivism rate of elderly crime became necessary in korea. In that context, elderly criminals oriented judicial policy which includes desirable devices of the proper judicial treatment for them in this paper was presented. Concretely, this paper shows new desirable devices including senior policeman for them, remote trial for them, exclusive elderly prison and so on. In conclusion, this paper shows forensic welfare paradigm and its practical measures in judicial procedure for elderly criminals.

노인범죄자는 오랫동안 형사사법절차에서 노인범죄자들은 그 수적인 열세로 인하여 형사사법정책의 중심에서 간과되어 왔다. 그러나 한국사회에서 급속한 고령화와 사회 변화의 복잡화는 많은 노인범죄자들을 양산하게 되었다. 따라서 더 이상 기존의 형사사 법정책으로는 증가되는 노인범죄에 대처하는데 다양한 한계를 보이게 되었으며, 노인 범죄의 재범률을 낮추는데 새로운 형사사법정책이 필요하게 되었다. 그런 맥락의 차원 에서 노인범죄자들에 대한 적절한 사법처우를 위한 바람직한 방안들을 내포하는 노인 범죄자 지향적인 형사사법정책을 본 논문에서 주장하게 되었다. 구체적으로는 본 논문 에서는 노인전담경찰제도, 노인범죄자들에 맞는 원격화상재판, 노인전담 교정시설 등 새로운 발전방안들을 기술하고 있으며, 결론에서는 노인범죄자들에 대한 형사사법절차에서 사법복지의 패러다임과 그 실천방안들을 나타내고 있다.
