Juvenile participatory trial system was implemented in 2010 modeled after American teen court program as a way of therapeutic jurisprudence.
In our juvenile participatory trial system for the minor offence juvenile, peer juries who consist of peer conducts a peer trial and impose an implement task on juvenile offenders.
After their sincere implementing the imposed task, a decision of no-trial will be followed by a juvenile court judge.
Korean juvenile participatory trial system has diverse problem in addition to benefits. But the existing studies of it insist on diverse problems in a different way with me. Therefore, I would like to explain my original criticism against the exsisting studies in a different point and to show the essential problem of it.
In that context, I explained approach to improve the korean juvenile participatory trial system in terms of the ideological aspect and so on through my interdisciplinary view.
I would like to show the secret symbolic violence and culture violence of our system and the its desirable direction including break up of symbolic violence which is a key difference against the existing studies.

우리나라의 청소년참여법정은 미국의 청소년 참여법정을 모델로 하여 치료사법의 일 환으로 2010년에 도입된 제도이다. 경미한 비행자들을 대상으로 하는 청소년참여법정 제도는 또래들로 구성된 청소년참여인단이 심리와 부과과제의 선정을 하고 선정된 부 과과제를 비행소년이 성실히 이행하면 심리불개시로 연결되는 소년보호제도이다.
이러한 한국형 청소년참여법정제도는 장점과 문제점이 있다. 그런데 그러한 문제점 에 대해 선행연구들이 다각도로 주장하나 여기서는 그런 선행연구들과 전혀 다른 관점 에서 선행연구들의 문제점을 독창적으로 지적함으로써 쟁점을 예각화시켜 무엇이 보다 청소년참여법정의 본질적 문제인가를 드러내고자 하였다.
그러한 맥락에서 한국형 청소년참여법정의 문제점과 개선방안을 이념적, 인적, 물적, 체제적 측면에서 학제적 관점을 통하여 독창적으로 운론하였다. 동시에 한국형 청소년 참여법정에 깊숙이 도사린 비의도적인 은밀한 상징폭력과 문화폭력의 가능성을 제시하고 그러한 상징폭력의 해체방안을 제시함으로써 청소년참여법정의 나아갈 방향을 제시 한 바 바로 이런 점들이 기존 논문들과의 차이점이며 존재이유이다.
